The Traffic Civil Guard would have intercepted a Mercedes-AMG One at 199 km/h these days with a radar, circulating on the A-1512 road, in the municipality of Cella (Teruel). The vehicle, registered in Germany, was traveling on a section limited to 90 km/h (Europe Press).
The vehicle was intercepted on November 13, after being identified by the Traffic Agents of the Teruel Civil Guard Command while operating a radar. The case would have gone to the disposal of the Teruel Investigating Court number 1, which would be in charge of investigating a possible crime of speeding. Remember that in a section limited to 90 km/h, driving at more than 170 km/h is considered a crime. The Criminal Code establishes, in fact, that speeding can be considered a crime in the following circumstances:
- 30 km/h limit (city): drive over 90 km/h
- Limit of 50 km/h (city): travel at more than 110 km/h
- Limit of 90 km/h (city): travel at more than 170 km/h
- Limit of 120 km/h (city): travel at more than 200 km/h
When a radar photo is a crime
This is established in article 378.1 of the Penal Code:
Whoever drives a motor vehicle or a moped at a speed greater than sixty kilometers per hour on urban roads or eighty kilometers per hour on interurban roads than what is legally permitted, will be punished with a prison sentence of three to six months or with the of a fine of six to twelve months or with that of works for the benefit of the community of thirty-one to ninety days, and, in any case, with the deprivation of the right to drive motor vehicles and mopeds for a period of more than one and up to four years
If after investigation the perpetrator is found guilty of a crime, he or she could face the following sanctions:
- Imprisonment from 3 to 6 months, a fine from 6 to 12 months, or work for the benefit of the community from 31 to 90 days
- Deprivation of the right to drive motor vehicles and mopeds for between one and four years
